"Equipment" means the tools, machinery, or items listed in the Hire Schedule.
"Hire Period" means the duration from the time the equipment leaves the Owner’s premises until it is returned to or collected by the Owner.
"Hire Charges" means the rates and fees specified in the current price list or individual quote.
2. Hire Period
Commencement: The hire period begins when the Equipment leaves the Owner’s possession and ends when the Equipment is returned to the Owner’s premises or collected by the Owner.
Extensions: If the Hirer wishes to extend the hire, they must notify the Owner at least 24 hours before the original end date. Extensions are subject to availability and additional charges.
3. Charges and Payment
Payment: All hire charges and deposits must be paid in full at the time of booking
Deposit: A refundable security deposit is required. The Owner reserves the right to withhold all or part of the deposit to cover damages, cleaning, or late return fees.
Late Fees: If equipment is not returned by the agreed time, additional daily hire charges will apply at the standard rate until the equipment is returned.
4. Delivery & Collection
Inspection: The Hirer must inspect the Equipment upon receipt. Any defects or damage must be reported to the Owner immediately. Failure to do so implies the Equipment was received in good working order.
Return Condition: Equipment must be returned in the same condition as it was received, clean, and with all accessories. If the equipment is returned dirty, a cleaning fee will be charged.
5. Use and Maintenance
Permitted Use: The Hirer shall use the Equipment only for its intended purpose and in accordance with the manufacturer’s instructions.
Restrictions: The Hirer shall not:
Modify or alter the Equipment.
Sublet or transfer the Equipment to a third party.
Use the Equipment outside the agreed geographical area without prior consent.
Maintenance: The Hirer is responsible for routine checks (e.g., oil levels, fuel, tire pressure) during the hire period.
6. Damage, Loss, and Theft
Liability: The Hirer is responsible for the Equipment from the time of delivery until return.
Loss/Damage: In the event of loss, theft, or irreparable damage, the Hirer is liable for the full replacement cost of the Equipment. For repairable damage, the Hirer is liable for the cost of repairs and any loss of income while the equipment is unavailable for hire.
Theft: Any theft must be reported to the police and the Owner immediately, with a crime reference number provided.
7. Insurance and Indemnity
Insurance: The Hirer is responsible for ensuring they have adequate insurance coverage for the Equipment against theft, loss, or damage, and for public liability during the hire period.
Indemnity: The Hirer agrees to indemnify the Owner against all claims, costs, or damages arising from the use of the Equipment, including injuries to third parties or damage to property.
8. Limitation of Liability
The Owner is not liable for any indirect or consequential loss, including loss of profit, business interruption, or delays caused by equipment failure. The Owner’s total liability is limited to the amount of the Hire Charges paid.
9. Termination
The Owner may terminate this agreement immediately if the Hirer breaches any of these terms. Upon termination, the Hirer must return the equipment immediately. If the Hirer fails to do so, the Owner reserves the right to enter the Hirer’s premises to recover the Equipment.
